Latest bid to keep Warwick gym which opened without permission

A Warwick gym which opened without the proper planning permission has launched a fresh bid to the council.

Foundry Gym has submitted a new planning application to Warwick District Council (WDC) asking for temporary permission to use Horizon House as a gym.

A previous submission to the local council claimed the chain was "misadvised" by a property agent which said it had the proper permission to open.

Previously a vehicle hire business, the building on Millers Road is currently classed as 'B2/B8' - industrial use. 

Foundry wants to change it to 'Class E' which allows for a wide range of commercial and business use.

In its latest application to WDC, the gym said: "The application proposes the temporary (until 2 April 2028) retrospective change of use of this warehouse style building previously used in vehicle rental use to a gym which falls within Use Class E. 

"The proposal also involves associated off-street parking located on Lock Lane."

The previous submission was withdrawn for consideration to address the feedback from residents.

A huge number of supportive comments and complaints were submitted to the last application, with many residents questioning the impact on parking and the local roads.

Foundry now says it has found a solution.

The new application continued: "The main concern that was raised in respect of the previous application was the perceived issues associated with parking on surrounding roads. 

"This application now robustly addresses this matter and proposes an additional 52 off street parking spaces on a nearby site located on Lock Lane. 

"These spaces are in addition to the 17 spaces at the site and 11 spaces on the adjacent Pickering site giving a total of 80 off street spaces now being proposed."

The temporary change of use would run until the gym's current lease ends.

If it were to extend the lease, a new application would need to be submitted.

"The request for temporary planning permission requires the use to be discontinued at the end of the temporary period," plans stated. 

"Should the lease be formally extended a subsequent application would be submitted to extend the temporary period accordingly. 

"The temporary nature of the application has the advantage of enabling the council to consider the proposals again should an application be submitted to extend the temporary period."
