Plans to keep 'misadvised' Warwick gym which opened without planning permission pulled

A Warwick gym which claimed it was 'misadvised' in opening without planning permission has pulled its retrospective application.
Foundry Gym on Millers Road had been forced to submit a planning application after finding out it did not have planning permission to open.
The plans have proved divisive with locals, with over 200 comments having been sent to Warwick District Council.
Comments are split between objections and supportive notes, but the application for Horizon House has now been withdrawn by the gym.
This follows a recent objection from Warwick Town Council which criticised the lack of parking and the noise from the gym.
It added: "If retrospective planning permission were to be granted, Warwick Town Council requests this is with conditions to limit the operating hours from 7am - 10pm due to the impact on amenity in the area."
The chain has not said why the plans have been pulled.
The original application says there would be no external alterations aside from signage.
Previously a vehicle hire business, the building is currently classed as 'B2/B8' - industrial use. Foundry wants to change it to 'Class E' which allows for a wide range of commercial and business use.
"When taking on the premises the applicants were misadvised by the property agents and legal advisers who indicated on numerous occasions both verbally and in writing that the premises had the correct use class in place to enable them to use the building as a gym," the application said.
It continued: "Unfortunately, on the back of this advice the applicants have proceeded to invest considerable funds in refurbishing the building to make it suitable for its intended use."
